The NMC Investigation Process
Referral & Triage
The NMC receives a referral from an employer, patient, colleague, or other source. They conduct an initial review to determine if there's a realistic prospect the allegations, if proven, would indicate current impairment of fitness to practise. You'll receive written notification of the referral and allegations.
Investigation Stage
You'll be asked to provide your written response to the allegations. The NMC will gather evidence including witness statements, medical records, policies, and other documentation. This stage can take 6-18 months or longer. Your response is critical - we help you draft a strong defence that addresses each allegation while protecting your position.
Case Examiner Review
A Case Examiner reviews all evidence to decide if there's a realistic prospect that a fitness to practise panel would find current impairment. They can: close the case with no further action, issue a warning, agree an undertaking with you, or refer to a fitness to practise hearing. We can make representations to the Case Examiner to avoid a hearing.
Interim Orders (If Applicable)
If the NMC believes public protection requires it, they may seek an interim order suspending you or placing conditions on your practice while the case is ongoing. These are temporary measures but can affect your employment and visa. We represent you at interim order hearings to argue against suspension or for minimal conditions.
Fitness to Practise Hearing
A three-member panel (including a registered nurse) hears evidence from the NMC and your defence. The hearing considers: (1) Are the facts proved? (2) Do the proven facts amount to misconduct/lack of competence? (3) Is your fitness to practise currently impaired? (4) What sanction or order is appropriate? Hearings typically last 2-5 days. Expert representation is crucial.
Sanctions & Appeals
If impairment is found, sanctions range from: no action, warning, conditions of practice order (up to 3 years), suspension order (typically 6-12 months), to striking off (removal from register). You have 28 days to appeal to the High Court. We advise on appeal prospects and represent you in appeal proceedings. Even after a sanction, we can help with restoration applications and compliance with conditions.
